“Market Quiz” and “Bundesliga Prediction Game”

Rules, Terms and Conditions

The ”Deutschlandfest-Market Quiz“ and the “Deutschlandfest-Prediction Game” are open to the general public residing in South Africa. Employees of the German Foreign Office or affiliated with any Institution of the Federal Republic of Germany, as well as their immediate families, are welcome to participate in the competitions, but are not eligible for any of the prizes.

1. Administrator
The Administrator of the quiz and the prediction game is the German Embassy (called ”The Adminstrator“ in the following), 201 Florence Ribeiro Avenue, Groenkloof, Pretoria, SA.

2. How To Enter
Quiz: Any individual residing in South Africa, ticking the right answers in the quiz and submitting the filled answer sheet to the German Embassy’s stand on 9 Nov 2019 by 1.30 pm, including their name, cell phone number and Email address, will be entered into a draw. The right answers have to be identifiable unequivocally.
One quiz sheet may be handed in per person only. Administrator reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process; violates the official rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy abuse, threaten or harass any other person. By entering, entrant accepts and agrees to be bound by these official rules.

Prediction Game: Any individual residing in South Africa, predicting the correct result of one of the live broadcast Bundesliga matches, submitting the filled answer sheet to German Embassy staff inside the ABE beer hall at 012 Central at the beginning of the predicted match, including their name and cell phone number, will be entered into a draw. One prediction slip may be handed in per person only. Administrator reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process; violates the official rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy abuse, threaten or harass any other person. By entering, entrant accepts and agrees to be bound by these official rules.

3. Prizes
Via random draw, prizes will be allocated to the winners. Administrator reserves the right to any final decision with regard to contest rules and rule changes, and to the prizes awarded to the winners. Prizes may not be endorsed, transferred, substituted or redeemed for cash, except at the Administrator’s sole discretion. Specifics of the prizes are subject to change in Administrator’s sole discretion. Administrator reserves the right to substitute a prize of equal or greater value if the awarded prize is unavailable for any reason.

4. Winner Selection
Each participant must comply with all terms and conditions set forth in these Rules, and winning is contingent upon fulfilling all requirements. A winner will be selected from all quiz sheets/prediction slips received. Decisions are final and binding in all matters related to the selection. Selection of the quiz winner will be announced at around 2 p.m. on the main stage of the Deutschlandfest event on November 9^th, 2019. Winners for the prediction game will be announced after the relevant game is over on November 9^th, 2019. Administrator assumes no responsibility/liability for damages, losses or injury resulting from acceptance or use of the prize. In the event that the winner is unable to comply with the terms and conditions set forth in these Official Rules, the administrator reserves the right to deem such individual ineligible and to select a new winner from among the remaining entries.

5. Notification
Winners will be notified in person at the Deutschlandfest event. Winners not present at the time of the draw will be notified by Email/SMS. However, if there is no response to the Email/SMS within a week of notification, the entry will be considered invalid and another name will be drawn. Winners will have to redeem the prize at the German Embassy Pretoria. Administrator will provide address and pick-up details to the winner. If prize is not collected within eight weeks of arranged pick-up date, the winner’s rights to the prize will be forfeited.

6. General Rules
Administrator is not responsible for technical malfunctions which may limit the ability to participate or by any human error which may occur in the processing of the entries in this contest. Administrator reserves the right to cancel the promotion if it becomes technically corrupted, and award prize from eligible entries received prior to cancellation. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, entrant’s rights and obligations, or the rights and obligations of the Administrator in connection with the contest, shall be governed by, and construed in accordance with, the laws of South Africa, without giving effect to any choice of law or conflict of law rules. Administrator does not submit to the jurisdiction of a South African court, and does not waive its sovereign immunity by entering into this Agreement or submitting to a dispute resolution mechanism.

CAUTION: ANY ATTEMPT BY A CONTESTANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, ADMINSTRATOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Privacy Notice
Winners will be asked for full name, e-mail account and telephone number. By submitting a contribution, entrant agrees to correctly and completely state the data inquired once receiving communication about a win. Administrator reserves the right to remove any entrant from the competition not complying with these terms without prior notice. The contact information provided by entrant are to enable the Administrator to contact if entrant is selected a winner. Administrator values the privacy of entrants and will use entrant data only for the purposes described above. In particular, Administrator will not pass on the data to third parties.

8. Winners
The names and pictures of the prize winners will be announced at the Deutschlandfest on Nov 9^th, 2019 at around 2pm (for the quiz) and after the respective Bundesliga matches (for the prediction game). During the hand-over, the winner agrees to have a picture taken with him/her and the prize.

9. Any recourse to courts of law excluded.
